Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you (“you” or “Customer”) and ProtectMyWebsite, a sole proprietorship (“ProtectMyWebsite,” “we,” “us,” or “our”), governing your access to and use of the ProtectMyWebsitemanaged web application firewall service available at www.wafcybersecurity.com (the “Service”). By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ProtectMyWebsite provides a managed web application firewall (“WAF”) built on Amazon Web Services (“AWS”). When you connect a website, your visitor traffic is routed through Amazon CloudFront and AWS WAF, where it is filtered according to the rules you and we configure, and clean requests are passed to your origin server. We set up provisioning, TLS/SSL certificates, rule tuning, and alerting on your behalf. Your website, hosting, and content remain yours and stay where they are; we sit in front of them by means of a DNS change.

2. Eligibility & Accounts

  • You must be at least 18 years old and able to form a binding contract.
  • You agree to provide accurate account information and to keep it current.
  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • Notify us promptly at support@wafcybersecurity.com of any unauthorized use of your account.

3. Your Responsibilities

  • You represent that you own, or are authorized to protect and route traffic for, every domain you add to the Service.
  • You will use the Service only for lawful purposes and will not use it to host, transmit, or shield unlawful, infringing, or malicious content, or to facilitate attacks on others.
  • You are responsible for your origin server, your DNS records, and your own application security. The Service reduces risk; it does not replace secure development, patching, or backups on your side.

4. Fees, Billing & Taxes

The Service is billed per protected website at $150 per site per month, or $1,650 per site per yearif you choose annual billing. Subscriptions are billed in advance through our payment processor, Stripe, and renew automatically for successive periods until cancelled. You authorize us and Stripe to charge your payment method for all fees, including overage fees described below. Fees are exclusive of taxes; you are responsible for any applicable sales, use, or similar taxes.

4.1 Traffic Allowances & Overage (Pass-Through) Charges

Each protected site includes a monthly allowance of 300 GB of bandwidthand 5 million requests. If a site exceeds its allowance in a billing period, you agree to pay overage charges that pass through our underlying AWS costs, billed to your payment method as additional charges:

  • $0.12 per additional GB of bandwidth, and
  • $1.50 per additional million requests.

Overage is metered from AWS CloudWatch usage data and billed as separate line items, typically at or near the end of a billing period. You can view live bandwidth and request usage against your allowance in your dashboard at any time, and we make reasonable efforts to email you before material overage accrues. These overage rates may change on notice; we will not change them retroactively for usage already incurred.

4.2 Failed Payments & Suspension

If a charge fails, we may retry it and may suspend or remove protection for the affected site(s) until payment is resolved. Suspension may expose your origin to traffic that the Service would otherwise filter.

5. Cancellation & Refunds

Monthly plans are month-to-month. You may cancel at any time, and removing a site or cancelling stops billing for the next cycle; you retain protection through the end of the period you have already paid for. Fees already paid are non-refundable, and we do not provide refunds or credits for partial periods, unused time, or overage already incurred, except where a refund is required by applicable law. Annual plans are paid in advance for the year and are non-refundable except as required by law.

6. Service Availability; No Guarantee of Security

We work hard to keep the Service available and effective, but no web application firewall can guarantee that every attack will be blocked or that your site will never experience downtime, false positives, or a security incident. The Service is provided without any guaranteed uptime or service-level commitment unless we agree to one separately in writing. Filtering rules that block legitimate traffic, or that fail to block a malicious request, are an inherent characteristic of any WAF; you remain responsible for monitoring and tuning protection for your site, with our assistance.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROTECTMYWEBSITE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless ProtectMyWebsite from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content or websites, your violation of these Terms, or your violation of any law or third-party right.

10. Suspension & Termination

We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to our infrastructure. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete your configuration and data in the ordinary course.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law & Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in North Carolina, and you consent to personal jurisdiction there.
